@ Erika - I can understand how you might come to such a conclusion. However, the man was no threat to anyone. Suppose that an intoxicated man was WALKING home from a bar after making a responsible decision that he should not drive. That man could just as easily stumble into the roadway. Should that man be arrested because he could POSSIBLY get in the way of vehicles? Even though he DID NOT actually do it.
If so, it would likely be for public intoxication. DUI enforcement is not about reducing/eliminating the incidence of DUI. If it were, the law and public policy would not punish those that choose not to drive a motor vehicle while impaired.

I can say it was a good thing to arrest him because it could have been possible to get in the way of the vehicles driving. Although he was wasn't driving a vehicle he was intoxicated and could have swirved in front of vehicles.

I believe in the punishment for drinking and driving. This man was arrested on suspicion of riding a bicycle while under the influence. I don’t understand, we are told not to drink and drive. “Drink drive go to jail.” He wasn’t driving, yes it can endanger him by riding a bike while under the influence but at lest he isn’t driving 100 mph and swerving right? The court system should realize that he did choose a safer way, he didn’t drive and that’s all that should matter.

If they arrested 100 people that night, the Madders would say,"Wow,we got 100 drunk drivers off the road" ! When no one gets arrested, the Madders say,"See, these roadblocks do deter drunk driving". A win-win thing for the anti alcohol fanatics from MADD.
