		<description>The legal limit was put in place for a reason.  I don&#039;t see how judges and prosecutors are getting around that.  If they want to change the legal limit, fine.  But right now we are supposed to be operating under established laws, not potential laws.</description>

		<description>Seems like they need to blame someone for this tragedy, and if they can attach the DUI stigma, then it gives them free range to crucify someone so the public and families of this incident feel justice has been served.</description>

Lots of people make the mistake of passing at the wrong time that results in accidents and deaths unfortunately at times. Do they get charged like this too?
