Very good site, Mr. Taylor. I have never had a DUI, but I do recognize the subversion of the Constitution through such laws.

Unfortunately, emotionally-driven arguments substitute for reason. Everything is reduced down to emphasizing the victims of drunk drivers. Tragic as those cases are, it is equally tragic when somebody becomes a victim of prosecutorial/judicial misfeasance.

One thing that I believe DUI laws open the door for is punishing non-crime. If a drunk driver hits and kills somebody, that should no doubt be punished as vehicular manslaughter. However, a DUI charge is, objectively, punishing the act of drinking.

And what about cases where somebody who had been drinking decided to wait until they were sober enough to drive by sleeping inside of their vehicle, hadn't even driven, but got a DUI for the mere act of being in their car?

I came across your site by reading about the case of Randy Wilkinson who was charged with a DUI, but hadn't even consumed any alcohol. I fear that one day that could be me.

I had to receive three shots of the anthrax vaccine just before I got out of the Marine Corps, and I have had some health problems ever since. Right around that same time - i.e., just aftering receiving the anthrax shots - I noticed that my pupils became more dilated and have stayed that way. I noticed that because I became more visually sensitive to lights.

My now-naturally-dilated pupils are often times conflated with symptoms of drug-use, despite never even using drugs and having several drug tests to prove this.

I could very easily see how a police officer could use my dilated pupils as the pretext to run me up on a DUI charge.

BTW, Semper Fi, Mr. Taylor!
